General Terms and Conditions
Effective from January 1, 2026
I. Basic and Introductory Provisions
This is a translation. The Czech version of this document is binding.
1.1. These General Terms and Conditions (hereinafter the “GTC”) govern the mutual rights and obligations arising in connection with the conclusion and performance of contracts between the Contractor and the Customer, in particular in the provision of servicing work, diagnostics, repairs and remanufacturing-modification of engines and their components, as well as the sale of remanufactured engines, spare parts and other related goods.
1.2. The Contractor means JM MOTOR MOTION spol. s r.o., with its registered office at Antonína Dvořáka 1317, 768 24 Hulín, company ID (IČO): 09161228, VAT ID (DIČ): CZ09161228, entered in the Commercial Register maintained by the Regional Court in Brno, Section C, File 117574 (hereinafter the “Contractor”).
Contractor’s contact details: e-mail info@motormotion.cz, telephone +420 604 109 935, workshop address Antonína Dvořáka 1317, 768 24 Hulín.
1.3. The Customer means a natural person or legal entity that concludes a contract with the Contractor, in particular a contract for work, a purchase contract or another contract related to the activities stated in Art. 1.1 of these GTC (hereinafter the “Customer”).
1.4. The Contractor provides goods and services mainly on the basis of individual orders, job sheets, price quotes, contracts or other individual arrangements between the Contractor and the Customer.
1.5. The Customer may conclude a contract with the Contractor as a Consumer or as a Business.
1.6. For the purposes of these GTC, a Consumer means a natural person who, when concluding and performing a contract with the Contractor, acts outside the scope of their business activity and outside the scope of the independent exercise of their profession.
1.7. For the purposes of these GTC, a Business means a Customer who concludes a contract with the Contractor in connection with their business activity or the independent exercise of their profession. A legal entity concluding a contract within the scope of its activity is also a Business.
1.8. If the Customer’s company ID (IČO) is stated when the contract is concluded, or if it is evident from the circumstances that the Customer is acting in connection with their business activity, the Contractor may reasonably assume that the Customer is concluding the contract as a Business, unless the specific circumstances indicate otherwise.
1.9. Unless these GTC expressly state otherwise, their provisions apply to all Customers. Provisions expressly intended only for Consumers or only for Businesses apply exclusively to the relevant group of Customers.
1.10. If the Customer is a Consumer, the relevant consumer protection legislation also applies to them. These GTC do not limit or exclude any rights of the Consumer that cannot be removed by contract under the law.
1.11. If the Customer is a Business, the provisions intended exclusively for the protection of Consumers do not apply.
1.12. In the event of a conflict with these GTC, individual arrangements between the Contractor and the Customer take precedence.
II. Order and Conclusion of the Contract
2.1. Telephone, e-mail or other communication between the Contractor and the Customer before the vehicle, engine or other item is handed over to the Contractor generally serves to agree in advance on the scope of the job, the deadline, the price or other conditions of its performance, and does not in itself constitute the conclusion of a contract, unless the parties expressly agree otherwise.
2.2. Unless the Contractor and the Customer expressly agree otherwise, a contract for servicing work, repair or remanufacturing-modification of an engine is concluded at the moment the Contractor takes over the vehicle, engine or other item and the Customer confirms the job sheet.
2.3. Depending on the nature of the specific job, the contractual relationship may also arise on the basis of an individual order, price quote, contract or other demonstrable arrangement, provided that it clearly shows the parties’ intention to conclude a contract.
2.4. The job sheet contains or refers to, in particular, the subject and agreed scope of the job, the price or the method of determining it, the expected completion date and any other individual conditions of the specific job.
2.5. Depending on the nature of the job, a job sheet, order, price quote or other individual arrangement may be approved in particular by signature, by e-mail, by SMS or other electronic communication, by telephone, in person or in another demonstrable way.
2.6. Where possible given the nature of the job, the Contractor and the Customer agree on a fixed price for the agreed scope of the job before the work begins. This price applies only to performance included in the agreed scope.
2.7. If determining the actual technical condition of the vehicle, engine or its component requires diagnostics, disassembly, dismantling, measuring or other professional operations, the Contractor is entitled to carry out these operations to the extent approved by the Customer, even before the final scope of any repair can be determined.
2.8. If, in the course of the job, the Contractor discovers further defects, damage or a need for further work, spare parts or material not included in the originally agreed scope, the Contractor informs the Customer.
2.9. Additional work, services, spare parts or material will be carried out or used only with the Customer’s prior approval.
2.10. The Customer’s consent to a change in scope or price may be given in writing, by e-mail, by SMS or other electronic communication, by telephone, in person or in another demonstrable way.
2.11. The Contractor informs the Customer of the price of the additional work or of the change in the total price of the job. Without the Customer’s consent, the Contractor is not obliged to continue with the additional work.
2.12. If the Customer does not approve additional work or the repair of a discovered defect, the Contractor is entitled to end the work in the relevant scope. The Customer pays the price of the work already carried out and approved, in particular diagnostics, disassembly, dismantling, measuring, cleaning and other operations, as well as the price of the material and spare parts used or approved.
2.13. In the case under Art. 2.12, the item will be handed over to the Customer in a condition corresponding to the work already carried out. If handover requires reassembly, completion or other work not included in the original scope or price, the parties will agree on its scope and price.
2.14. The Contractor is not obliged to carry out reassembly or completion in a manner that contradicts professional practice or technical requirements, or in a manner that could lead to damage or endanger operational safety.
2.15. If the Customer is a Consumer, the Contractor provides them, upon accepting the order, with the information and confirmation required by law.
III. Price and Payment Terms
3.1. The price for carrying out the work, providing the service, or supplying spare parts, material or other goods is agreed in particular in the job sheet, price quote, order or other individual arrangement.
3.2. The agreed price applies only to the approved scope of the job. Changes to the scope and price are governed by Art. II of these GTC.
3.3. After the price of the job has been set and approved by the Customer, the Contractor issues a Payment Request, which contains in particular the amount to be paid, payment details and the due date.
3.4. The Customer is obliged to pay the amount stated in the Payment Request properly and by the stated deadline.
3.5. Unless individually agreed otherwise between the parties, after the price of the job is approved the Contractor requires payment of the entire agreed price before the job is completed. Receipt of the required payment is a condition for continuing and completing the job.
3.6. Payments received will be properly accounted for. The Contractor issues the Customer the relevant accounting and tax documents in accordance with applicable legislation.
3.7. If the Customer does not pay the Payment Request properly and on time, the Contractor is entitled not to begin or to interrupt the work, not to order the necessary parts or material, or not to complete the job until the required payment is received.
3.8. If the price of the job is increased with the Customer’s consent, the Contractor is entitled to issue a further Payment Request corresponding to the approved increase.
3.9. The vehicle, engine or component will be handed over to the Customer after the job is completed and after all due amounts relating to the given job have been paid in full, unless the parties agree otherwise.
3.10. If the Customer is in default with payment of a due amount, the Contractor is entitled to claim statutory default interest and other rights under the law.
IV. Completion Date and Handover of the Job
4.1. The Contractor informs the Customer of the expected completion date when accepting or confirming the job.
4.2. Unless a fixed deadline is expressly agreed, the stated date is an expected date. The Contractor strives to complete the job by this date.
4.3. If the scope of the job changes, the expected completion date may also be adjusted accordingly. The Customer will be informed of the change.
4.4. The deadline is extended appropriately by the period during which the Contractor could not continue with the job because of the Customer’s delay or failure to provide necessary cooperation, in particular because of non-payment of the Payment Request, late approval of additional work, or failure to provide necessary information or documents.
4.5. The job is completed at the moment the agreed work has been carried out or the agreed performance delivered and the vehicle, engine or component is ready for handover to the Customer.
4.6. After completion, the Contractor notifies the Customer that the item is ready for collection, in particular by telephone, SMS, e-mail or another commonly used means of communication.
4.7. The Customer is obliged to collect the completed job without undue delay and to fulfil any remaining payment obligations.
4.8. At handover, the Customer is entitled to review the scope of the work carried out and the condition of the vehicle, engine or component being handed over. The Customer confirms collection of the job by signing the delivery note or another handover document.
4.9. Collection of the job does not affect the Customer’s rights arising from defective performance.
V. Taking Over a Vehicle, Engine or Other Item for a Job
5.1. For the purpose of carrying out a job, the Customer may hand over to the Contractor a vehicle, an engine or individual components.
5.2. Depending on the nature of the job, the Contractor records the basic condition of the vehicle, engine or components and any obvious damage upon taking them over.
5.3. The condition of the vehicle, engine or components may be recorded in the job sheet, in other documentation or by photographic or visual documentation.
5.4. The Contractor may send the Customer confirmation of takeover or related information by e-mail, SMS or another commonly used means of communication.
5.5. The Customer is obliged to inform the Contractor of all facts known to them that are relevant for diagnostics, repair or the safe performance of the work, in particular known defects, previous repairs, modifications or non-standard interventions.
5.6. Before handing over the vehicle, the Customer is obliged to remove valuables, documents, money and other personal belongings that are not necessary for carrying out the job.
5.7. The Contractor is not liable for defects, damage or the technical condition of an item that existed before it was taken over and were not caused by the Contractor’s activity.
5.8. If the Contractor discovers further defects or circumstances that could not be detected at takeover and that affect the scope, price or further procedure, the Contractor informs the Customer and proceeds in accordance with Art. II of these GTC.
5.9. Where necessary for diagnostics, verification of a defect or checking the result of a repair, the Contractor is entitled to handle the handed-over vehicle, engine or component to the extent necessary to carry out these operations.
5.10. A procedure under Art. 5.9 may include a reasonable test drive of the vehicle, where needed for diagnostics, verification of function or checking the result of a repair.
5.11. The Contractor or a person authorised by the Contractor carries out the test drive only to the extent corresponding to its purpose.
VI. Spare Parts, Material and Replaced Components
6.1. When carrying out a job, the Contractor uses spare parts and material that the Contractor sources itself according to the nature and technical requirements of the job.
6.2. The Contractor normally uses new spare parts, unless expressly agreed otherwise.
6.3. Because of its responsibility for the quality of the work and the technical suitability of the components used, the Contractor does not, as a rule, install spare parts or material supplied by the Customer, unless expressly agreed otherwise.
6.4. The Contractor chooses the specific manufacturer or type of spare part with regard to technical requirements, availability, quality and the purpose of the repair.
6.5. The Contractor generally keeps removed or replaced parts for a reasonable period so that they can be inspected or shown to the Customer.
6.6. If the Customer wishes to have the replaced parts returned, the Customer must notify the Contractor at the latest when the job is taken over by the Contractor.
6.7. If the Customer does not express interest in collecting them, the Contractor is entitled, after a reasonable period, to arrange for their disposal, recycling or other appropriate handling.
6.8. If the supply of a spare part is conditional on returning the original part to the supplier, in particular for engine accessories, the original part will not be returned to the Customer. The Customer will be informed of this in advance. Return of the original part may also be a condition of the agreed price of the spare part.
6.9. Where appropriate, the Contractor may show the Customer a replaced part before its disposal in order to explain the defect or the work carried out.
VII. Special Conditions for Remanufacturing-Modification of Engines
7.1. Remanufacturing-modification of an engine is a set of professional work on the engine and its components to the extent agreed with the Customer.
7.2. As part of the remanufacturing-modification, the Contractor checks the technical condition of the relevant engine components and, as needed, repairs, modifies or replaces them within the scope of the agreed job.
7.3. If the Contractor discovers a defect or an unsatisfactory technical condition in related systems or components that may affect the proper function of the engine, the Contractor informs the Customer. Any further work is governed by Art. II of these GTC.
7.4. If the Customer declines a recommended repair or replacement of a component whose condition may affect the function or service life of the engine, the Contractor warns the Customer of the possible consequences of that decision.
7.5. When installing a remanufactured engine, the professional installation and technological procedures set by the Contractor and the relevant vehicle or engine manufacturer must be observed. The installation does not have to be carried out by the Contractor itself, but it must be carried out professionally and in accordance with those procedures and instructions.
7.6. Before the engine is put into operation for the first time, it must be properly filled with the prescribed engine oil, fitted with the appropriate oil filter, and the lubrication system must be filled and bled according to the Contractor’s individual instructions.
7.7. Depending on the specific engine type, the Contractor may specify further mandatory or recommended operations before commissioning or during the running-in period, in particular inspection or replacement of related components, inspection of the injection system or adjustment of settings via diagnostics.
7.8. Specific installation, operating and servicing instructions may be stated in particular on the delivery note, the Invoice, the job sheet or other documentation of the specific job.
7.9. The Customer is obliged to ensure that these instructions are also followed when installation or subsequent servicing is carried out by a third party.
7.10. The Customer is obliged to ensure, no later than after 3,000 km have been driven from the first commissioning of the remanufactured engine, that the engine oil and oil filter are replaced as part of the running-in regime. The engine oil and oil filter used for the replacement must correspond to the prescribed specification for the given engine type.
The replacement may be carried out by the Contractor or by another professional service. It must be evidenced by a service document stating the date, identification of the vehicle or engine, odometer reading (if available), specification of the oil and filter used, and identification of the service. The Customer is obliged to keep this document and present it to the Contractor on request.
7.11. The Customer is obliged to ensure a service inspection of the remanufactured engine between the 5th and 6th month after takeover of the engine. The inspection includes in particular:
- engine diagnostics,
- checking the injector corrections,
- checking the engine’s running,
- reading the fault memory,
- visual inspection of the engine and of any leaks of operating fluids.
The inspection may be carried out by the Contractor or by another professional service. Performance of the inspection must be evidenced by a service report stating the date of the inspection, identification of the vehicle or engine, odometer reading (if available), the scope and results of the inspection carried out, and identification of the service that carried out the inspection. The Customer is obliged to keep the service report and present it to the Contractor on request.
7.12. If unusual noise, insufficient oil pressure, overheating, leakage of operating fluids, excessive smoke, a significant loss of power, a warning signal or any other sign of a possible serious defect appears, the Customer is obliged to stop operating the engine without undue delay and contact the Contractor.
7.13. Failure to follow the installation, operating or servicing instructions and continued operation despite obvious signs of a defect will be taken into account when assessing liability and complaints only if and to the extent that they are causally connected with the occurrence of the defect or damage.
7.14. Remanufacturing-modification may change the original operating characteristics of the engine, its load, maintenance requirements and the service life of related components. The scope and parameters of a specific modification are agreed individually.
7.15. After completing the remanufacturing-modification, the Contractor is entitled to fit the engine with a control seal, which serves to determine whether the engine was tampered with after handover.
7.16. The Customer must not remove, damage or otherwise break the control seal without the Contractor’s prior consent.
7.17. If, for technical or servicing reasons, it is necessary to intervene in the engine in a way that could break the control seal, the Customer is obliged to contact the Contractor in advance and agree the further procedure with them.
VIII. Sale of Remanufactured Engines on an Exchange Basis
8.1. The Contractor may sell remanufactured engines on an exchange basis, on condition that the Customer hands over their original engine of the same type and code for subsequent remanufacturing.
8.2. Unless agreed otherwise, the Customer hands over the original engine at the same time as taking over the remanufactured engine.
8.3. Under the exchange basis, the Contractor takes over the original engine free of charge. By handing the original engine over to the Contractor, ownership of the engine passes to the Contractor, unless the parties agree otherwise.
8.4. Upon takeover, the Contractor checks the type, code, completeness and obvious technical condition of the original engine.
8.5. A condition of the exchange basis is the handover of an engine of the same type and code whose essential structural parts are suitable for subsequent remanufacturing. The original engine must be handed over complete, as is usual for an engine of the given type, unless the parties agree otherwise.
8.6. If the Contractor finds that an essential component of the returned engine is missing, irreparable, or damaged to an extent that prevents its further use, the Customer may be charged a corresponding surcharge.
8.7. The amount of any surcharge for an incomplete, irreparable or otherwise unsatisfactory original engine is governed by the amount agreed in advance or the method of determining it. If the amount of the surcharge or the method of calculating it has not been agreed in advance, the Contractor sets it individually according to the engine type, the extent and nature of the damage, and the current costs of procuring or sourcing replacement components.
8.8. The Contractor informs the Customer of the determined technical condition of the original engine and of any surcharge before billing it. If the amount of the surcharge or the method of calculating it has not been agreed in advance, the surcharge will be billed only after the Customer’s approval.
8.9. If no agreement is reached on the surcharge or another method of settlement, the parties will agree on the further procedure.
8.10. A remanufactured engine is normally released only after handover of an original engine meeting the conditions of the exchange basis, or after any surcharge has been agreed and paid.
8.11. In exceptional cases, the Contractor may allow the remanufactured engine to be taken over before the original engine is handed over.
8.12. If later return of the original engine is agreed, the Customer is obliged to hand it over within 7 calendar days of taking over the remanufactured engine at the latest, unless a different period is agreed in writing.
8.13. If the Customer does not return the original engine within the agreed period, the Contractor is entitled to claim an individual financial settlement corresponding to the type and value of the missing exchange engine and the circumstances of the specific case.
8.14. By handing over the original engine, the Customer confirms that they are entitled to dispose of it and that, to the best of their knowledge, it does not originate from criminal activity and is not encumbered by third-party rights preventing its handover.
8.15. If the Contractor has reasonable doubts about the origin of the engine, the Customer’s authority to dispose of it, or the consistency of its identification data, the Contractor is entitled to refuse to take over the engine under the exchange basis.
8.16. Handover of the original engine may be confirmed by a delivery note, handover document or another document relating to the specific job.
IX. Rights from Defective Performance, Warranty and Complaints
9.1. The Contractor is responsible for ensuring that the remanufacturing-modification of the engine is carried out properly, professionally and to the extent agreed with the Customer.
9.2. In addition to the statutory rights from defective performance, the Contractor provides a quality warranty on the remanufactured engine for 12 months from the day the Customer takes it over. The warranty applies to the remanufactured engine within the scope of the remanufacturing-modification carried out, not to other components and systems of the vehicle that were not the subject of the job.
9.3. If the Customer is a Consumer, the provision of this warranty does not limit their statutory rights from defective performance.
9.4. The Customer’s rights from defective performance are assessed according to the nature of the specific contract, in particular whether it concerns the repair or remanufacturing of an engine owned by the Customer, the sale of a remanufactured engine or the supply of other goods, and whether the Customer acts as a Consumer or as a Business.
9.5. If a remanufactured engine is sold to a Consumer as a used item, the period for giving notice of a defect may, under the conditions set by the Civil Code, be shortened to as little as 12 months. Such a shortening must be validly agreed and recorded accordingly. The quality warranty provided is not affected by it.
9.6. When assessing a complaint, regard is had to compliance with the installation, operating and servicing conditions under Art. VII and the individual instructions relating to the specific engine, including the mandatory replacement of engine oil and oil filter as part of the running-in regime and the subsequent mandatory service inspection.
Failure to comply with these obligations may be taken into account when assessing a complaint only if and to the extent that it is causally connected with the occurrence of the defect or damage complained of.
9.7. Where necessary to assess the cause of a defect, the Customer is obliged to provide cooperation and available documents relating in particular to the installation of the engine, servicing, the operating fluids used and the replacement of oil and filters.
9.8. The Customer may file a complaint in any demonstrable way, in particular in person, by telephone, by e-mail, by SMS or by another commonly used means of communication.
9.9. In the complaint, the Customer describes the defect and provides details enabling the job to be identified. Where possible, it is recommended to attach photographs, video or other documentation of how the defect manifests itself.
9.10. Before a third party dismantles the engine that is the subject of a complaint, the Customer is obliged first to contact the Contractor and allow the Contractor to propose a procedure for assessing the complaint. If intervention by others makes it impossible or substantially more difficult to determine the cause of the defect reliably, this may be taken into account when assessing the complaint. A complaint may be rejected on this ground only if, as a result of such intervention, it is not possible to reliably assess the existence or cause of the defect complained of.
9.11. If the engine is fitted with a control seal, the Contractor may check that it is intact when a complaint is filed. Breaking or removal of the control seal may be taken into account when assessing the complaint, in particular if the engine could have been tampered with after handover or if such tampering could have been connected with the defect complained of.
9.12. Where necessary, the Contractor is entitled to carry out diagnostics of the engine that is the subject of a complaint and, to the extent necessary, to disassemble or dismantle it.
9.13. The warranty and the Contractor’s liability do not extend to defects or damage demonstrably caused by a circumstance unrelated to a defect in the remanufacturing-modification carried out, in particular incorrect installation or operation of the engine, failure to follow installation, operating or servicing instructions, use of unsuitable operating fluids, a fault in related systems or components of the vehicle, mechanical damage arising after handover of the engine, continued operation despite obvious signs of a serious defect, or normal wear and tear.
9.14. Art. 9.13 applies only if and to the extent that there is a causal connection between the stated circumstance and the defect or damage complained of.
9.15. If the Customer is a Business and the complaint proves to be unjustified, the Contractor is entitled to charge the costs reasonably incurred for diagnostics, disassembly, dismantling or other necessary professional operations, at the rate of CZK 1,390 per hour including VAT.
If the Customer is a Consumer, no fees will be charged to them for the assessment of a complaint, even if it is rejected.
9.16. If a complaint is recognised as justified, the Contractor will primarily remedy the defect by repairing the engine complained of. If repair is not possible, expedient or proportionate, the complaint may be settled by replacing the engine or in another way corresponding to the nature of the defect and to the law. This does not affect the Consumer’s statutory rights to another form of remedy.
9.17. If the Customer is a Consumer, the Contractor decides on the complaint without delay, in complex cases within 3 working days. A period reasonably required for expert assessment of the defect is not included in this period.
The complaint, including the remedy of the defect, will be settled and the Consumer informed of this no later than 30 days from the day it was filed, unless the Contractor agrees a longer period with the Consumer.
9.18. If the Customer is a Business, the complaint will be settled within a reasonable time corresponding to the nature of the defect and the technical difficulty of assessing or remedying it. The Business is obliged to notify the defect without undue delay after discovering it or after it could have been discovered with due care.
9.19. Unless agreed otherwise, the Customer normally arranges transport of the engine or vehicle that is the subject of a complaint to the Contractor. If a Consumer’s complaint is justified, they are entitled to compensation of the costs reasonably incurred, to the extent provided by law.
9.20. If a complaint is settled by repairing or replacing the engine, a new twelve-month warranty period does not automatically begin to run. The length and running of the warranty period are governed by the warranty provided and the relevant legislation, unless expressly agreed otherwise.
9.21. When accepting a complaint from a Consumer, the Contractor provides confirmation to the extent required by law and, once the complaint is settled, informs the Consumer of how it was settled.
X. Uncollected Job, Storage and Costs
10.1. If the Customer does not collect the completed job without undue delay after being notified under Art. 4.6 of these GTC, this does not automatically give rise to an obligation to pay storage fees.
10.2. If leaving the vehicle, engine or other item begins to place on the Contractor, given its duration or the circumstances, a disproportionate operational, space or other burden, the Contractor is entitled to demonstrably call on the Customer to collect it.
10.3. In the call, the Contractor gives the Customer an additional period of 7 calendar days and warns the Customer that storage fees may be charged after it expires without result.
10.4. The amount of the storage fee will be set individually according to the nature of the item, space and handling requirements and other circumstances. The Contractor will inform the Customer in advance of the specific amount or the method of calculation.
10.5. The storage fee may be charged at the earliest from the day following the unsuccessful expiry of the additional seven-day period.
10.6. If leaving the item for a long time causes further extraordinary costs, in particular costs of handling, transport or external parking, the Contractor may demand payment of them only after prior notice to the Customer.
10.7. If the Customer does not collect the item even then, the Contractor is entitled to use any further means that the relevant legislation allows it in relation to an uncollected item.
XI. Liability for Damage
11.1. The Contractor is liable for damage caused by breach of its contractual or statutory obligations to the extent provided by law.
11.2. The Contractor is not liable for damage demonstrably caused by a defect or malfunction of a component or system of the vehicle that was not the subject of the job, if there is a causal connection between that defect and the damage incurred.
11.3. The Contractor is not liable for damage, or the part of it, that arose or increased as a result of the Customer’s acts or omissions, in particular failure to follow instructions, continued operation despite obvious signs of a defect, refusal of a recommended repair, or unprofessional intervention by a third party.
11.4. Art. 11.2 and 11.3 apply only to the extent that the stated circumstance actually contributed to the occurrence or increase of the damage.
XII. Contracts Concluded at a Distance or Away from the Contractor’s Business Premises
12.1. The provisions of this article apply only if the Customer is a Consumer and the contract was concluded at a distance or away from the Contractor’s business premises, in particular when the vehicle, engine or component is taken over at the Customer’s location or at another place outside the Contractor’s workshop.
12.2. If the contract was concluded in the manner under Art. 12.1, the Consumer may withdraw from the contract within the period set by law, generally within 14 days of concluding a contract for services or of receiving the goods in the case of a purchase contract.
For contracts concluded during an unsolicited visit by the Contractor to the Consumer’s home or at an organised sales event, the statutory withdrawal period is 30 days.
The right of withdrawal does not apply in cases where the law expressly excludes it. This does not affect the Consumer’s other statutory rights.
12.3. Before such a contract is concluded, the Contractor provides the Consumer with information about the right of withdrawal and a model withdrawal form, if the Consumer has this right.
12.4. If the provision of the service is to begin before the withdrawal period expires, the Contractor begins the work on the Consumer’s express request made in accordance with the law. The Consumer will at the same time be informed of the consequences of beginning or fully completing the service before this period expires.
12.5. If the Consumer withdraws from the contract after the provision of the service has already begun at their express request, they may be obliged to pay a proportionate part of the price corresponding to the performance provided up to the moment of withdrawal, if the statutory conditions are met.
12.6. If the service was provided in full before the withdrawal period expired at the Consumer’s express request and the other statutory conditions were met, the Consumer’s right of withdrawal may lapse.
12.7. The Consumer may withdraw by any unambiguous statement addressed to the Contractor; the Consumer may also use the model form provided by the Contractor.
12.8. If the contract is concluded in the ordinary way at the Contractor’s workshop upon takeover of the vehicle, engine or component and confirmation of the job sheet, the provisions of this article on the right of withdrawal for contracts concluded at a distance or away from business premises do not apply.
XIII. Out-of-Court Resolution of Consumer Disputes
13.1. If the Customer is a Consumer and a dispute arises between them and the Contractor from the contract which cannot be resolved by mutual agreement, the Consumer is entitled to file a proposal for out-of-court resolution of the consumer dispute.
13.2. The body competent for out-of-court resolution of consumer disputes is the Česká obchodní inspekce (Czech Trade Inspection Authority), Ústřední inspektorát – oddělení ADR (Central Inspectorate – ADR Department), Gorazdova 1969/24, 120 00 Praha 2, e-mail adr@coi.gov.cz.
Information on out-of-court resolution of consumer disputes and on the option to file a proposal electronically is available on the website of the Czech Trade Inspection Authority.
13.3. Before filing a proposal, the Consumer will first try to resolve the dispute directly with the Contractor.
13.4. The Consumer may file the proposal within the period set by law.
13.5. Out-of-court resolution of the dispute does not affect the parties’ right to turn to the competent court.
13.6. This article applies exclusively to Consumers.
XIV. Personal Data Protection
14.1. The Contractor processes Customers’ personal data in accordance with the relevant legislation, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
14.2. Detailed information on the scope, purposes, legal bases and period of processing of personal data, the recipients of the data and the rights of Customers is set out in a separate document, Personal Data Protection, available on the Contractor’s website and at its workshop.
XV. Final Provisions
15.1. Legal relations between the Contractor and the Customer are governed by these GTC, individual arrangements between the parties and the relevant legislation of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code, as amended.
15.2. If any provision of these GTC is or becomes invalid, ineffective or inapplicable, this does not affect the other provisions, unless the nature or purpose of the provision concerned indicates otherwise.
15.3. The Contractor is entitled to change or update these GTC, in particular because of changes in legislation, operating procedures or the scope of the services provided.
15.4. Unless agreed otherwise, a specific contractual relationship is governed by the wording of the GTC in effect at the moment the relevant contract is concluded. A later change to the GTC does not automatically apply to a job already concluded.

15.6. By confirming a job sheet, contract, order or other document referring to these GTC, the Customer confirms that the GTC were made available to them before the contract was concluded and that they had the opportunity to become familiar with them.
15.7. The parties will preferably resolve any disputes by mutual agreement. This does not affect the right to turn to the competent court or the Consumer’s right to use out-of-court dispute resolution under Art. XIII.
15.8. These GTC become valid and effective on 1 January 2026.
