This is a translation. The Czech version of this document is binding.

The personal data controller is JM MOTOR MOTION spol. s r.o., with its registered office at Antonína Dvořáka 1317, 768 24 Hulín, company ID (IČO): 09161228, VAT ID (DIČ): CZ09161228, e-mail info@motormotion.cz, telephone +420 604 109 935 (hereinafter the “Controller”).

The Controller processes personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (hereinafter the “GDPR”), Act No. 110/2019 Coll., on Personal Data Processing, and other relevant legislation.

This policy informs you what personal data we process, for what purpose, on what legal basis, for how long, to whom it may be disclosed, and what rights the persons whose data we process have.

2. What Personal Data We Process and Where We Get It

In connection with providing our services, in particular diagnostics, repairs, servicing, remanufacturing and modification of engines, and the sale of remanufactured engines, spare parts and other related goods, we may process in particular:

  • first name and surname
  • residential or registered office address
  • telephone number and e-mail address
  • company ID (IČO), VAT ID (DIČ) and other identification data
  • billing and payment details
  • data on the vehicle, engine and the specific job
  • data stated in the order, job sheet, delivery note, invoice or other related documentation
  • the content of mutual communication
  • data needed to handle a complaint or other customer request

We generally obtain personal data directly from customers, through the web form, e-mail, telephone, or in person, when taking over a vehicle or engine, and in the course of carrying out the job.

Where necessary, we may also obtain data from persons acting on behalf of the customer, persons handing over or taking over a vehicle or engine, or from business partners.

We process only personal data that is adequate and necessary for the specific purpose.

3. Purposes and Legal Bases of Personal Data Processing

We process personal data only on the basis of an appropriate legal ground, in particular for the following purposes:

a) Performance of a contract or steps prior to entering into one. Under Art. 6(1)(b) GDPR, we process data necessary for handling inquiries and orders, preparing price quotes, concluding and performing a contract, carrying out jobs, communicating with customers and handing over the completed job or delivered goods.

b) Compliance with legal obligations. Under Art. 6(1)(c) GDPR, we process personal data necessary to comply with statutory obligations, in particular in the area of accounting, taxes and the keeping of related documentation.

c) Legitimate interest of the Controller. Under Art. 6(1)(f) GDPR, we may, to the necessary extent, process data for the purpose of protecting our rights and property, recording and documenting the course of the contractual relationship, resolving possible disputes, and establishing, exercising or defending legal claims.

d) Consent. Where no other appropriate legal basis exists for specific processing of personal data, we require the consent of the person concerned under Art. 6(1)(a) GDPR.

Providing the personal data necessary for concluding and performing a contract is needed for the proper acceptance and handling of the job. Without this data it may not be possible to carry out the job, communicate about its progress or issue the relevant documents.

4. Personal Data Retention Period

We keep personal data only for the time necessary to fulfil the purpose for which it was obtained, or for the period set by the relevant legislation.

We keep data relating to inquiries, orders and jobs for the time needed for communication with the customer, carrying out the job, handling complaints, and protecting or enforcing related legal claims.

We keep accounting, tax and other documents for which the legislation sets a mandatory archiving period for the period set by that legislation.

Once personal data is no longer needed for any of the stated purposes and there is no legal ground for keeping it further, it will be deleted or anonymised.

5. To Whom Personal Data May Be Disclosed

We do not sell personal data or provide it to third parties without an appropriate legal ground.

To the necessary extent, it may be disclosed in particular to:

  • providers of accounting and tax services
  • providers of IT services, information systems and website administration
  • providers of e-mail and other communication services
  • carriers, suppliers and business partners, where necessary for handling a specific job
  • legal, tax and other professional advisers
  • public authorities, where the obligation to provide the data arises from legislation

To operate the website, we use the technical services of Vercel (web hosting) and Cloudflare (technical delivery of the web form).

In connection with the use of these services, personal data may be processed or transferred outside the European Economic Area, in particular to the USA. Such transfers must be secured by an appropriate protection mechanism under the GDPR, for example on the basis of an adequacy decision under the EU–US Data Privacy Framework, if it applies to the relevant recipient, or by other lawful safeguards.

Where another entity processes personal data on our behalf, its relationship with the Controller is set up in accordance with the requirements of the GDPR.
